FOR WHOM IS THE TNS SCHEME

You can qualify for an allowance under the Regulations for non-salaried victims of mesothelioma (TNS) if:

the diagnosis of malignant mesothelioma has been confirmed by the Dutch Mesothelioma Panel (NMP) or by the expert group of the Dutch Association of Physicians for Pulmonary Diseases and Tuberculosis (NVALT);

You are not eligible for the Asbestos Victims Arrangement (TAS Regulations);

You have lived in the Netherlands continuously for a period of at least ten years. This period is between 10 and 60 years before the time of your application;

You have not received compensation for immaterial damage in connection with the mesothelioma disease of € 20.355, – (2018) or more;

You have not received payment on the basis of a foreign facility for mesothelioma victims or have submitted an application for this which has not yet been decided;

You issue an authorization to recover the costs through the courts. (If the causer pays compensation, the compensation will be settled with this).

You must also provide all information and, where possible, documentary evidence regarding the exposure to asbestos and the period in which the exposure took place. Survivors of victims can be entitled to a benefit under the scheme if the victim has already made a request for mediation at the Asbestos Victims Institute. Next of all dependents are:

The spouse, spouse or partner;

If it is not there, the minor children;

If there are no underage children, the person with whom the deceased lived as a family.

The allowance amounts to a maximum of € 20.355, – (2018).
