TAS SCHEME FOR ASBESTOSIS VICTIMS
You can qualify for an advance on the grounds of the Asbestos Victims Compensation Regulation (TAS) if:
You as an employee have been exposed to asbestos for an intensive and long-term period of at least 15 years before the diagnosis of pulmonary fibrosis by the treating physician;
You worked in the Netherlands;
The diagnosis of asbestosis has been confirmed by the Dutch Asbestosis Panel (NAP), an expert group of the Dutch Association of Physicians for Pulmonary Diseases and Tuberculosis (NVALT). The NAP also assesses the severity of your lung function disorder on the basis of the classification of the American Medical Association. (AMA) (see below). From class 2 you are eligible for the advance payment.
AMA Class 0: no advance
AMA class 1: no advance
AMA class 2: € 20.355, –
AMA class 3: € 20.355, –
AMA class 4: € 20.355, –
You have not received payment in connection with asbestosis or mesothelioma;
You issue an authorization to recover the costs through the courts. (If the employer pays compensation, the compensation will be settled with this).
Survivors of victims can be entitled to a benefit under the scheme if the victim has already made a request for mediation at the Asbestos Victims Institute. Next of all dependents are:
The spouse, spouse or partner;
If it is not there, the minor children;
If there are no underage children, the person with whom the deceased lived as a family.
The allowance amounts to a maximum of € 20.355, – (2018).
