YOU HAVE THE DISEASE MESOTHELIOMA OR ASBESTOSIS

You can be eligible for a government reimbursement if you have been diagnosed with mesothelioma or asbestosis by contact with asbestos in the Netherlands. Sometimes the (former) employer pays compensation. Below is the description:

APPLICATION

You register with the IAS: via the application form of our website, by telephone (079 – 7507150) or with the reply card from the IAS leaflet “Asbestos and Mesothelioma” or the IAS leaflet “Asbestos and Asbestosis” . The IAS employee completes the application forms together with you by telephone. In a second interview, the IAS will discuss with you how the contact with asbestos took place. This conversation can be done by telephone or at home. The IAS will then send you the completed forms immediately afterwards.

You check the formulation and send it back signed. You also authorize the IAS to request medical information and the Social Insurance Bank (SVB) to recover any damages through the courts.

ALLOWANCE

The IAS asks the Dutch Mesothelioma Panel (NMP) or the Dutch Asbestosis Panel (NAP) for confirmation of the diagnosed malignant mesothelioma or asbestosis (with the corresponding AMA class). For Mesothelioma, in case of doubt, a reassessment is requested from the mesothelioma working group of the pulmonologist association NVALT.

The IAS then advises the SVB to grant or pay the allowance. If the SVB decides positively, you will receive € 20.355, – (2018). The IAS and the SVB aim to complete this procedure within two months.

COMPENSATION

If you are exposed to asbestos by an employer, you are liable for this by registered letter. You can use the example letter sent to you by the IAS for this.

The IAS then examines whether the (former) employer is liable for your health damage and then mediates between you and the (former) employer or his insurer.

If the employer or insurer accepts liability, you will receive compensation. For mesothelioma of € 64,522, – and for asbestosis, € 23,586, -, € 42,439, – or € 61,291, – respectively, depending on the severity of the lung function loss. The IAS aims to complete this process within six months. Amounts apply for 2018.
