HOW DOES THE APPLICATION FOR A COMPENSATION FOR ASBESTOSIS WORK
The asbestosis patient registers himself or through his contact at the IAS: by e-mail via www.ias.nl, by telephone (079 7507150) or by using the reply card from the folder.
After receiving the signed application form and medical authorization, the IAS medical advisor will contact the treating pulmonologist to obtain the relevant information from the medical file and the radiology and pathology examinations of the person concerned.
The IAS investigates whether there is intensive, long-term asbestos exposure as an employee or otherwise professionally. Among other things, use is made of Appendix E: Risk matrix of the asbestos diseases protocol: asbestosis of the Health Council (1999). The matrix determines how many years certain activities must have been performed or must have been worked in a certain profession to exceed the exposure threshold for asbestos.
The IAS provides the clinical material as much as possible digitally to the Dutch Asbestosis Panel (NAP) together with the conclusion of the labor history research or whether there is intensive / long-term asbestos exposure as an employee or otherwise professionally.
Applications for which the IAS has confirmed intensive, long-term exposure to asbestos are submitted to five panel members of the NAP for medical evaluation.
The panel members independently assess whether asbestosis is the most likely cause of lung function limitation and how large the lung function loss is.
The NAP aims to complete the assessment within three weeks after receiving the clinical material. The secretariat is located in the Antoni van Leeuwenhoek Hospital, Department of Thoracic Oncology.
In case of relevant asbestos exposure leading to loss of function class 2, 3 or 4 (AMA), the IAS advises the Social Insurance Bank (SVB) to grant an advance / allowance via the TAS or TNS Scheme of € 20.355, – (2018).
If there is a loss of function in class 2, 3 or 4, the (former) employer pays a compensation (basis) of € 23,586, -, € 42,439, – or € 61,291 (2018) respectively on acceptance of the liability.
If the treating pulmonologist examines a significant deterioration in lung function, which is expected to lead to classification in a higher AMA class, the applicant may submit a request for reassessment.
