COMPENSATION ASBESTOS VICTIMS
If a person has the disease mesothelioma or the disease asbestosis , he / she can, under the conditions of the Asbestos Victims Institute (IAS), be eligible under certain conditions for a contribution of € 20.355, This amount applies for 2018 and is indexed annually.
The IAS investigates with the victim how the contact with asbestos has taken place and advises the Social Insurance Bank (SVB) on the right to an allowance on the basis of the Asbestos Victims’ Disability Insurance Scheme 2014 (TAS) or the Scheme for non-salary-related victims of mesothelioma and asbestosis (TNS). The SVB then decides on the basis of the advice from the IAS whether or not to grant and pay the allowance.
ARRANGEMENT FOR ASBESTOS VICTIMS IN 2014 (TAS)
The Arrangement for asbestos victims in 2014 is intended for employees with mesothelioma or asbestosis as a result of working with asbestos. The TAS scheme has been in force since 26 January 2000 for workers with mesothelioma. Housemates with mesothelioma can also qualify for reimbursement from 1 July 2003 if, for example, they have been exposed to asbestos particles through the worker’s clothing and have been given mesothelioma as a result. As of April 1, 2014, the TAS regulation has been extended to employees who have been diagnosed with asbestosis as a result of intensive and long-term exposure to asbestos.
Sometimes asbestos victims with mesothelioma or asbestosis can not receive compensation from the (ex-) employer because it no longer exists, is untraceable or has gone bankrupt. It also happens that employers can appeal to prescription, making the victim ineligible for compensation. The Asbestos Victims (TAS) Compensation Scheme has been established for this group of victims. The purpose of the TAS regulation is to provide social security beneficiaries in the form of an advance on the possible compensation to be received from the employer.
The investigation into the liability of the (former) employer sometimes takes a long time. Therefore, the payment of € 20.355, – (2018) will first be paid to you in the form of an advance. This generally happens within 2 months after you have submitted your application. If the (ex-) employer is liable, the compensation will be settled with the final compensation. For this you grant an authorization in advance.
